Terms of Service
Last updated: September 30, 2026
1. Acceptance
By accessing or using BuildData (the "Service") at www.builddata.ca, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Service Description
BuildData provides access to Canadian construction and property records through a REST API, weekly feeds and bulk deliveries, including Snowflake Marketplace shares. Most of the data comes from municipal open data (building permits, business licences, planning and development applications, inspections and zoning); major projects, assessments and a few other datasets come from provincial and federal open data. These Terms cover every way you receive it.
3. Account and API Key
Access to the API requires a valid API key obtained at www.builddata.ca. You are responsible for keeping your key confidential and for all activity under your account.
4. Permitted Use
You may use the API to build applications, conduct research, and power internal or commercial data workflows, subject to your plan's rate limits. You may not:
- Resell or sublicense raw API responses as a competing data product
- Attempt to circumvent rate limits, scrape beyond your quota, or reverse-engineer the service
- Use the data to send commercial electronic messages that break Canada's Anti-Spam Legislation (CASL), or for calls that break the National Do Not Call List rules
- Use the Service for any unlawful purpose
What each source licence allows, the attribution it asks for, and what needs a written licence from us is set out on the data licence page.
Business contact information
Feeds and the Leads sheet include the phone number, email address and website of businesses named on public records. These are business contact details: a firm's own number, a general address such as info@ or office@, and its website. They come from what businesses filed with a municipality or a regulator, or published on their own websites. We do not include individuals' personal contact details.
You are responsible for how you use them. Email you send to these addresses is subject to Canada's Anti-Spam Legislation (CASL), and calls to the National Do Not Call List rules where they apply. Use them to contact a business about its work.
A business that does not want its contact details in what we send can ask us to remove them by writing to support@builddata.ca. We remove them from every feed and Leads sheet from the next send.
5. Plans, Changes, Billing, and Cancellation
Paid plans are billed monthly in advance via Stripe. Subscriptions renew automatically until cancelled. Cancellations take effect at the end of the current billing period. No refunds are issued for partial months.
We may change, add, or discontinue plans, rate limits, endpoints, datasets, and the free tier at any time. For a paid plan, we will give at least 30 days' notice by email before a change that materially reduces what the plan includes, and you may cancel before it takes effect. The free tier is provided without charge and may be changed, limited, or withdrawn at any time without notice.
6. Data Accuracy
Data is sourced from government records and processed automatically. While we strive for accuracy, we make no warranties regarding completeness, timeliness, or fitness for a particular purpose, and the data is provided "as is." Always verify critical information against the issuing authority's official record before relying on it.
7. Intellectual Property
The BuildData platform, API infrastructure, and derived data structures are owned by Nicolas Primeau. The underlying records remain the property of the municipalities and governments that publish them, under the licences listed on the data licence page.
8. Limitation of Liability
To the maximum extent permitted by law, BuildData and its operator are not liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability is limited to the amounts paid by you in the three months preceding the claim.
9. Modifications
We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance. Material changes will be communicated via email or a notice on the website.
10. Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes shall be resolved in the courts of Ontario.
11. Contact
